What is Public Procurement

Public Procurement represents one of the largest areas of public expenditure globally.
Estimates from The World Trade Organization (WTO) suggest that it accounts for 10-15% of global Gross Domestic Product (GDP).
(WTO 2011; OECD 2016).
In Jamaica, public procurement is estimated to represent roughly 30% of GDP.
(Ministry of Finance and the Public Service, 2018).
Public procurement represents such a significant share of national spending that the state effectively is the largest purchaser in the economy.

Since public procurement involves significant public expenditure, it is particularly vulnerable to mismanagement, fraud and corruption, in the absence of proper controls, strong governance and oversight.

At the end of this module ,participants should be able to:
Examine and discuss the laws, regulations and administrative guidance that governs public procurement.
Explain the roles and functions of the Office of Public Procurement Policy (OPPP) and its importance in policy development, oversight, and capacity building.
Recognize the key actors involved in the procurement cycle, outlining their responsibilities, decision making authority, and contributions to a transparent and accountable process.

The Roles, Functions and procedures of the Procurement Committee
This module aims to give participants a practical understanding of how Procurement Committees are established, how they operate, and the standards that guide their decisions. It explains the rules for appointment, the length of service, the committee’s core functions, procedures for meetings, and the ethical requirements expected of members. The module also reinforces the principles of fairness and transparency outlined in Section 5 of the Public Procurement Act.
Explain the mandate and main functions of Procurement Committees in the public procurement process which includes appointment and the expected period of service for committee members.
Outline the procedures for conducting meetings, including documentation, quorum, and decision‑making practices.
Apply the principles of fairness and transparency as required under Section 5 of the Public Procurement Act.
Identify potential conflicts of interest and demonstrate an understanding of the ethical standards required for committee members.

This module aims to equip participants with the knowledge required to apply the principles of fair competition in public procurement and how to identify practices that may unfairly restrict supplier participation. It explains what equal opportunity means, examine common barriers to competition and shows how to detect them. Participants will also examine issues such as contract splintering and learn when restricted competition may be legally justified.
At the end of the module, participant should be able to:
Explain the concept of fair competition and its importance in public procurement.
Identify common barriers to competition and detect warning signs in procurement documents, processes, or practices.
Recognize contract splintering and understand why it violates competitive procurement principles.
Determine when restricted competition may be lawful, based on acceptable justifications within the GOJ procurement framework.

Review of Key Procedures
This module provides participants with a practical understanding of key procedural requirements in the public procurement process. It covers the need for prior approval by the Head of Entity, mandatory advertising timelines, handling clarifications and addenda, managing conflicts of interest, and applying the specified evaluation criteria. Participants will understand these procedural requirements and be able to ensure compliance before approving a recommendation for the award of contract.
At the end of this module, participants will be able to:
Explain the procedural requirement for prior approval by the Head of Entity and when it applies.
Identify mandatory minimum advertisement timelines and ensure they are followed.
Apply the correct procedures for handling requests for clarification, issuing addenda, and extending bid submission deadlines. Recognize contract splintering and understand why it violates competitive procurement principles.
Recognize and address conflicts of interest among Evaluation Committee members.
Verify compliance with key procedural rules before endorsing a recommendation for contract award.

This module equips participants with the skills to review solicitation documents to ensure clarity, fairness, and compliance with procurement requirements. It explains the key components of a solicitation document and outlines the procedures related to the standstill period. The module also covers how to assess eligibility and qualification (technical & financial) requirements, and how to identify common pitfalls that may lead to challenges or delays in the procurement process.
At the end of this module, participants should be able to:
Identify the essential elements that must be included in a complete and compliant solicitation document.
Explain the purpose and requirement of the standstill period in the procurement process.
Review eligibility and qualification (technical and financial) requirements to ensure they are clear, fair, and objectively justifiable.
Identify the components of a solicitation document and verify that each section is properly presented.
Identify common pitfalls in solicitation documents that may lead to challenges, complaints, or delays.

This module provides participants with the skills to review evaluation reports to ensure they are complete, accurate, and aligned with the published evaluation criteria. It covers the essential elements that must be included in an evaluation report, how to verify scoring and their justifications, reasons for rejecting bids/offers, and the proper treatment of abnormally low or high bids/offers.
At the end of this module, participants should be able to:
Identify the required components of a compliant and well structured evaluation report.
Explain the principle of responsiveness and apply the principle to real world scenarios.
Verify scoring and their justifications for consistency, accuracy, and objectivity.
Evaluate the validity of bid rejection reasons to ensure they are fair, lawful, and properly documented.
Assess the treatment of abnormally low or high bids/offers in accordance with procurement rules and good practice.
